These Terms of Service (hereinafter “ToS”) apply to all orders placed via the online store of Alpinapharm GmbH ( Werftestrasse 4, 6005 Luzern, Switzerland, CH-418.342.525), hereinafter referred to as Alpinapharm. Web shop address: www.waldtrank.com

By placing an order through our Shopify web store www.waldtrank.com, the customer agrees to these ToS.

(I) Data Protection

  1. Personal Data
    Personal data includes information such as name, address, phone number, email address, payment details, and IP address.
  2. Collection and Use
    Personal data are collected only as necessary to process orders, provide services, and comply with legal obligations. Data is used exclusively for the execution of the order unless the customer has expressly consented to further use (e.g. newsletter subscription).
  3. Disclosure to Third Parties
    Personal data will only be shared with third parties where required for contract performance (e.g. payment providers, logistics partners) or where there is a legal obligation.
  4. Deletion and Rights
    Customers may request correction, deletion, or access to their personal data at any time by contacting info@alpinapharm.ch.
  5. Security
    Alpinapharm uses technical and organizational measures to protect personal data against unauthorized access, alteration, loss, or misuse.

(II) Offer and Conclusion of Contract

  1. Product Presentation
    The presentation of products in our Shopify store www.waldtrank.com does not constitute a legally binding offer, but an invitation to place an order.
  2. Ordering Process
    By clicking the “Checkout” or “Buy now” button, the customer places a binding order. The contract is concluded once Alpinapharm confirms the order by email.
  3. Errors
    Obvious errors, misprints, and technical errors remain reserved.

 

(III) Prices and Shipping Costs

1. Prices
All prices are listed in Swiss Francs (CHF) and include statutory VAT unless otherwise stated. The prices quoted in our offers and order confirmations are generally binding. However, errors and technical changes are reserved.

2. Shipping Costs
Shipping costs are shown separately during checkout.
Orders within Switzerland and Liechtenstein are shipped via Swiss Post (B-Post):

  • CHF 5.90 for orders between CHF 20.00 and CHF 69.99

  • CHF 3.90 for orders below CHF 20.00

  • Free shipping for orders of CHF 70.00 or more

3. International Orders
For deliveries outside Switzerland and Liechtenstein, the customer is responsible for all shipping costs as well as any customs duties, taxes, and additional fees. Customers are informed individually about the applicable shipping costs for international deliveries.

 

(IV) Delivery

  1. Delivery Times
    Products available from stock are generally dispatched within 48 hours. Delivery times are indicative and not binding.
  2. Risk Transfer
    The risk passes to the customer upon handover of the goods to the shipping service provider.

 

(V) Right of Withdrawal & Returns

1. Return period
Customers have the right to return goods within 14 days after receiving them, provided that the products are in their original packaging, unopened, and undamaged. No justification is required.

2. Shipping costs

  • The original delivery/shipping costs (the cost of sending the order to the customer) are always borne by the customer and are not reimbursed.
  • The cost of returning the goods is also borne by the customer.

3.        Refund
After receipt and inspection of the returned goods, provided they are in perfect condition, we will refund the purchase price of the goods only. Delivery costs (original shipment) and return shipping are excluded from reimbursement.

4.        Reservation
We reserve the right to make deductions from the refund or refuse reimbursement in cases of:

  • damaged or excessively worn goods,
  • opened or incomplete packaging,
  • or other non-compliance with the return conditions.
    In such cases, we may also issue an additional invoice for any resulting costs.

 

(VI) Payment Terms

  1. Payment Methods
    Payments may be made by credit card, Twint, or other methods offered via Shopify Checkout.
  2. Credit Card Payments
    The credit card is charged at the time of order confirmation or dispatch.
  3. Discounts & Vouchers
    Promotional codes, vouchers, or discounts cannot be combined unless expressly stated.
  4. Electronic Invoices: The customer acknowledges and agrees that invoices for all orders will be delivered electronically by email to the address provided at the time of order. Invoices will be sent as a PDF or another durable electronic format and will constitute the official invoice for accounting and tax purposes.

 

(VII) Retention of Title

The goods remain the property of Alpinapharm until full payment has been received.

 

(VIII) Liability

  1. Scope
    Alpinapharm is liable for defects in accordance with statutory provisions.
  2. Exclusions
    Liability for slight negligence, indirect damages, consequential damages, or lost profits is excluded to the extent permitted by law.
  3. Third-Party Links
    Alpinapharm accepts no liability for third-party content linked to from our Shopify store.

 

(IX) Final Provisions

  1. Partial Invalidity
    If any provision of these ToS is invalid, the remaining provisions remain effective. The invalid provision shall be replaced by one that most closely reflects the original intent.
  2. Amendments
    Alpinapharm reserves the right to amend these ToS at any time. The version in force at the time of the order applies.

 

(X) Applicable Law and Jurisdiction

These ToS and all legal relationships between Alpinapharm and the customer are subject to Swiss substantive law.
